These Terms govern your use of outfitmd.com and the services offered on it by Outfit Weight Management LLC, doing business as outfitMD (“outfitMD,” “we,” “us,” or “our”).

1. Acceptance of these Terms

By accessing or using outfitmd.com, submitting a form, booking a demo, or opting in to receive communications from us, you agree to these Terms and Conditions and to our Privacy Policy. If you do not agree, please do not use the website or our services.

2. Who we are and what we do

outfitMD is a technology and administrative services platform. We help wellness businesses — gyms, med spas, clinics, and virtual programs — offer physician-directed weight loss and wellness programs to their clients.

outfitMD is not a medical provider, pharmacy, or health insurer. All clinical services are delivered by independent, licensed physicians (“Program Physicians”) and licensed partner pharmacies who are not employees or affiliates of outfitMD. outfitMD does not practice medicine, does not prescribe medication, and does not direct or interfere with the independent clinical judgment of any licensed professional.

3. No medical advice

No treatment, medication, or clinical outcome is guaranteed. Whether any medication is appropriate is determined solely by a Program Physician following an individual clinical evaluation. Eligibility for any program does not guarantee a prescription.

4. Eligibility

This website and our services are intended for adults 18 years of age or older located in the United States. We do not knowingly collect information from anyone under 18. By using the website, you represent that you are at least 18 and, if you are acting on behalf of a business, that you have authority to bind that business.

5. Business clients and licensees

These Terms govern general use of the website. They do not by themselves create a commercial relationship between you and outfitMD.

Businesses that engage outfitMD to operate a weight loss or wellness program do so under a separate written agreement — the License and Administrative Services Agreement, together with any Client Service Agreement — executed by both parties. That agreement governs fees, scope of services, term, exclusivity, restrictive covenants, and all other commercial terms. Where that agreement conflicts with these Terms, that agreement controls as between outfitMD and the licensee. A copy is provided during onboarding and is available on request at [email protected].

Nothing on this website is an offer of a franchise or business opportunity, and no statement about potential revenue, savings, or business results is a guarantee. All businesses carry risk. You are responsible for your own due diligence and for compliance with the laws applicable to your business and jurisdiction.

6. Acceptable use of the website

You agree not to:

• Use the website for any unlawful purpose or in violation of these Terms;
• Attempt to gain unauthorized access to any part of the website, our systems, or another user's account;
• Interfere with or disrupt the website, including by introducing malware, scraping at a rate that burdens our systems, or circumventing security features;
• Impersonate any person or entity, or misrepresent your affiliation with one;
• Copy, reproduce, or redistribute our content or materials except as expressly permitted.

7. Submissions and accuracy

When you submit information through a form on this website, you agree that it is accurate and that you have the right to provide it. If you provide a phone number, you confirm that it belongs to you and that you are authorized to receive messages at it. You agree to notify us if your contact information changes.

8. SMS Terms of Service

This section governs the outfitMD messaging program. By providing your mobile phone number and opting in, you agree to these SMS Terms.

8.1 What we send

Depending on which consent you provide, you may receive:

• Customer care and transactional messages — replies to your inquiries, demo and appointment confirmations and reminders, account setup and status updates, order and renewal notifications, and support follow-ups.
• Marketing and promotional messages — program information, special offers, event invitations, and service announcements.

Each message type requires its own separate consent. You may opt in to either, both, or neither.

8.2 How you opt in

You can join this program by submitting your mobile number and checking a consent box on our contact form at outfitmd.com/contact, by completing a patient intake or enrollment form, by written or verbal agreement, or by texting us first.

Consent for marketing messages is collected through a checkbox that is separate from the checkbox for transactional messages. Neither checkbox is pre-checked, and consent is never assumed, inherited, or transferred from another program.

Consent to receive marketing text messages is not a condition of purchasing any product or service.

8.3 Message frequency and cost

Message frequency varies. Message and data rates may apply, depending on your carrier and plan. Carriers are not liable for delayed or undelivered messages.

8.4 How to opt out

You can cancel at any time by replying STOP to any message you receive from us. You will receive a single confirmation message and will not receive further texts from that program. You may also reply CANCEL, QUIT, END, UNSUBSCRIBE, OPTOUT, STOPALL, or REVOKE. To rejoin at any time, reply START.

8.5 How to get help

8.6 Supported carriers

This program is supported on major U.S. carriers, including AT&T, Verizon Wireless, T-Mobile, and their affiliates and resellers. Carriers are not liable for delayed or undelivered messages.

8.7 Eligibility

This messaging program is available only to individuals 18 years of age or older who reside in the United States and have a mobile number capable of receiving SMS messages.

8.8 Your mobile information

No mobile information or SMS opt-in data — including your mobile phone number and consent status — will be shared or sold to third parties or affiliates for marketing or promotional purposes.

This information is shared only with subprocessors that help us deliver the service, such as our messaging platform provider and telecommunications carriers, and only to the extent necessary to send messages on our behalf. Where applicable, information may also be shared with Program Physicians and partner pharmacies for treatment, payment, and healthcare operations, as described in our Privacy Policy. All other use case categories exclude text messaging originator opt-in data and consent; this information is not shared with any third party for its own use.

8.9 Content of messages

Standard text messaging is not an encrypted or fully secure channel. We limit the content of text messages so that they do not disclose diagnoses, medication names, or other sensitive health information, and we direct you to a secure channel when such information needs to be exchanged.

9. Email communications

If you provide your email address, you may receive service-related emails relating to your inquiry, account, or order. You may also receive marketing emails where you have opted in; you can unsubscribe at any time using the link in any marketing email or by emailing [email protected]. Service-related emails are not marketing and may continue after you unsubscribe from marketing.

10. Privacy

Our Privacy Policy explains what information we collect, how we use it, and the rights you have over it, including our HIPAA Notice of Privacy Practices. It is incorporated into these Terms by reference.

11. Intellectual property

The website and its content — including text, graphics, logos, software, program materials, and the “outfitMD” name and marks — are owned by Outfit Weight Management LLC or its licensors and are protected by intellectual property laws. You may view and print pages for your own reference. Any other use, including copying, redistribution, modification, or commercial exploitation, requires our prior written permission.

Businesses that license our program materials receive a limited, non-exclusive, non-transferable license under their separate written agreement. That license ends when the agreement ends.

12. Third-party links and services

The website may link to or embed third-party websites, tools, and services that we do not control. We provide these for convenience and do not endorse them or accept responsibility for their content, availability, or privacy practices. Your use of a third-party service is governed by that party's own terms.

13. Disclaimers

The website and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or that the website will be uninterrupted or error-free. Products and services supplied by third parties, including medications dispensed by licensed pharmacies, are provided without any warranty from outfitMD.

14. Limitation of liability

To the fullest extent permitted by law, outfitMD and its members, managers, officers, employees, contractors, and agents will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, arising out of or relating to your use of the website or these Terms, even if advised of the possibility of such damages. Nothing in this section limits liability that cannot be limited under applicable law.

15. Indemnification

You agree to indemnify and hold harmless outfitMD and its members, managers, officers, employees, contractors, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the website, your violation of these Terms, or your violation of any law or the rights of a third party.

16. Governing law and disputes

These Terms are governed by the laws of the State of New York, without regard to its conflict of law rules.

The parties will work in good faith to resolve any dispute. If a dispute is not resolved within thirty (30) days after written notice, it will be submitted to binding arbitration under the rules of the American Arbitration Association, conducted in Erie County, New York. Each party bears its own expenses and one half of the arbitrators' fees. Nothing here prevents either party from seeking injunctive relief in a court of competent jurisdiction to protect intellectual property or confidential information.

17. Changes to these Terms

We may update these Terms from time to time. Updates will be posted on this page with a revised “Last updated” date. Your continued use of the website after an update means you accept the revised Terms. If a change materially affects an existing messaging or service relationship, we will provide notice where required by law.
